1. Acceptance of Terms

3. Eligibility

You have the authority to agree to these Terms and to perform your obligations hereunder
4. Definitions
Payment Instrument: Credit card, debit card, UPI, net banking, prepaid instruments, IMPS, or any other payment methods enabled by banks or financial institutions from time to time.
Platform: The website operated by The LuxeBay Store where products are listed and transactions are initiated.
Transaction: An order placed by the User to purchase products listed on the Platform.
Transaction Amount: The total amount paid by the User for a Transaction.
User: Any person accessing or using the Platform.
5. Transactions & Payments
Upon completion of a Transaction, the User enters into a legally binding contract with The LuxeBay Store to purchase the selected products.
All payments must be made through authorized Payment Instruments only. The Merchant shall not be responsible for payment failures, authorization declines, or technical issues arising from banks, payment gateways, or third-party service providers.
6. Merchant’s Rights
The LuxeBay Store may collect, store, process, and share User information as required for:
Processing Transactions
Delivering products
Customer support and grievance handling
Fraud detection, legal, or regulatory compliance
in accordance with applicable laws.
7. User Responsibilities
The User agrees to:
Provide accurate, complete, and up-to-date personal and payment information
Maintain confidentiality of account credentials and transaction details
Use legitimate and lawful sources of funds for payments
The User shall be solely responsible for any unauthorized use of their Payment Instruments.
8. Orders, Returns & Refunds
After delivery, returns, replacements, or refunds are accepted only if:
The product received is damaged, or
The product received is different from what is shown or described on the Platform
Refund or return requests must be raised within the prescribed timeframe and may require supporting proof. Approval shall be subject to verification and governed strictly by the Returns & Refunds Policy of The LuxeBay Store.
9. Prohibited Actions
Users shall not:
Engage in fraudulent, misleading, or unlawful activities
Circumvent security features of the Platform
Upload malicious software, spam, or harmful content
Misuse the Platform for unauthorized commercial purposes
Attempt to reverse engineer or disrupt Platform functionality
Violation may result in suspension or termination of access without notice.
10. Limitation of Liability
To the maximum extent permitted under law:
The LuxeBay Store shall not be liable for indirect, incidental, or consequential damages
The sole remedy for defective or incorrect products shall be refund or replacement as per policy
The Merchant disclaims liability arising from payment gateway errors, bank failures, or third-party service disruptions
11. Reviews & User Content
Users may submit reviews provided they are truthful, lawful, and non-offensive.
The LuxeBay Store reserves the right to moderate, edit, or remove reviews at its sole discretion.
By submitting content, the User grants the Merchant a perpetual, royalty-free, non-exclusive right to use such content for business purposes.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The seat of arbitration shall be India, proceedings shall be conducted in English, and the arbitral award shall be final and binding.
Courts in India shall have exclusive jurisdiction for interim or injunctive relief.
13. Grievance Redressal
For transaction-related issues, refunds, or complaints, Users may contact customer support using the details provided on the Platform.
14. Disclaimer
All Transactions are undertaken at the User’s own risk and discretion.
The Platform is provided on an “as is” basis without warranties of uninterrupted or error-free operation.
The LuxeBay Store shall not be responsible for losses arising due to unauthorized access, technical failures, or force majeure events.
